Janet Jackson's famous 'wardrobe malfunction' caused outrage in America back in 2004 but now the TV company fined over the inccident have won an appeal.
CBS were originally ordered by he Federal Communications Commission to make a whopping £275,000 apology following the breast mishap during Janet's Superbowl performance 4 years ago.
However, at the appeal, judges ruled that the FCC had "acted arbitrarily and capriciously" in issuing the fine and BBS are now off the hook.
"This is an important win for the entire broadcasting industry because it recognises that there are rare instances, particularly during live programming, when it may not be possible to block unfortunate fleeting material, despite best efforts," a spokesperson for CBS said as the verdict was announced.
